
Oregon's products liability law uses the consumer expectations test, which says basically that a product which does not meet a consumer's expectations is defective, and the product manufacturer and sellers are liable for the damages caused by the defect. While that is simple in principle, product defect attorneys know that it often becomes technical in proof of the product defect. Manufacturer or government product recall will often help out with the proof, but products liability is still an area where you should have a product defect attorney involved early on for evaluation of liability and to investigate and document key factual issues.
